Shafique Law Associates is led by Shafique Ahmed. We meet clients in private at our office on Begum Road, Mozang Chungi, and what you tell us stays confidential.

Most family disputes in Pakistan are heard by the Family Courts under the Family Courts Act, 1964. We explain how your case is likely to run, which documents you need, and where a settlement may be possible before or during the case.

What we handle

Family matters we take on

Divorce (Talaq)

Notice, reconciliation and related claims

Under the Muslim Family Laws Ordinance, 1961, a husband who pronounces talaq must give written notice to the Union Council chairman, and the divorce takes effect after 90 days unless revoked. We advise on the notice, the reconciliation stage, and claims for dower and maintenance.

Questions

Family law questions

Short answers to questions clients ask us. Every case turns on its own facts, so speak to us before acting on any of them.

What is the difference between talaq and khula?

Talaq is a divorce pronounced by the husband and followed by notice to the Union Council. Khula is dissolution of the marriage at the wife's request through the Family Court, usually with the wife giving up her dower or other benefits. The procedure and the financial consequences differ.

Who gets custody of young children?

The court decides on the welfare of the child. Mothers are generally given custody (hizanat) of young children, while the father usually remains the natural guardian. Each case turns on its facts, including the child's age, health and living conditions.

Can I claim maintenance for my children?

Yes. A father is responsible for maintaining his children, and a claim can be filed in the Family Court. The amount depends on the father's means and the children's needs. The court can order interim maintenance while the case is pending.

Will my case be kept confidential?

Yes. What you tell us about your family matter is kept confidential. We meet privately and do not discuss your case with anyone without your permission.

Do you handle family cases outside Lahore?

Yes. We are based in Lahore and also act in family matters in other cities in Pakistan. Call us with the details and we will tell you how we can help.
