Intellectual Property Law
Protecting brands and original work
Shafique Law Associates is led by Shafique Ahmed. We advise entrepreneurs, companies and creators in Lahore and across Pakistan.
Trademarks in Pakistan are governed by the Trade Marks Ordinance, 2001 and registered through the Intellectual Property Organization of Pakistan (IPO-Pakistan). Copyright is governed by the Copyright Ordinance, 1962. We advise on both, and on passing off where a mark is not registered.

Questions
Trademark and copyright questions
Short answers to questions clients ask us. Every case turns on its own facts, so speak to us before acting on any of them.
What is the difference between a trademark and copyright?
A trademark identifies who is behind goods or services, such as a business name, logo or brand. Copyright protects original creative work, such as written content, photographs, artwork, designs and software. One business can rely on both.
Do I need to register my trademark?
Registration is not compulsory, but it gives you clear rights under the Trade Marks Ordinance, 2001 and makes infringement easier to act on. An unregistered mark may still be protected through a passing off claim, which requires proof of reputation and goodwill.
What is passing off?
Passing off is a claim against someone who presents their goods or services as connected with yours and so damages your goodwill. It can protect a business whose name or get-up has a reputation, even when the mark is not registered.
Someone copied content from my website. What can I do?
Copyright arises when an original work is created, so your content may be protected without registration. Keep evidence of the copying and of your original. A takedown request or legal notice is usually the first step.
